Thank you for choosing Suncore Transport for your medical transportation needs. These Terms and Conditions govern your use of the Suncore Transport website (the "Site") and our medical transportation services. By accessing or using the Site or our services, you agree to be bound by these Terms and Conditions.
 
1. Services
 
1.1 Description of Services: Suncore Transport provides non-emergency medical transportation services to individuals requiring assistance with transportation to and from medical appointments, treatments, hospitals, clinics, and other healthcare facilities. Suncore Transport is not a healthcare provider and does not provide medical advice, diagnosis, or treatment.

Our services are limited strictly to transportation.
 
1.2 Service Limitations: Our services are subject to availability and may be limited by factors such as scheduling constraints, geographic location, and regulatory requirements. We reserve the right to refuse service to any individual or cancel scheduled rides for reasons including but not limited to safety concerns, non-payment, or violation of these Terms and Conditions. This includes situations where, in the driver’s judgment, the passenger’s condition, behavior, or equipment creates a safety risk.
 
2. Booking and Payments
 
2.1 Booking Process: To request transportation services, you must submit a booking request through our website, mobile app, or by contacting our customer service team. Booking requests are subject to confirmation and availability. By booking, you agree to Suncore Transport’s Terms & Conditions, including our liability disclaimer.
 
2.2 Payment: Payment for transportation services is due at the time of booking unless otherwise arranged. We accept various forms of payment, including credit cards, debit cards, and insurance coverage where applicable. Prices for our services are provided on our website and may vary based on factors such as distance, time, and service type.
 
2.3 Cancellation and Refunds: Payments are applied toward allocated costs and resources scheduled in advance to ensure your reservation is held and services are available as agreed. 
Due to these committed expenses, all payments are non-refundable. Cancellations may be made at any time; however, no refunds will be issued regardless of the timing or circumstances.
 
3. User Responsibilities
 
3.1 Accuracy of Information: You (or any Responsible Party booking on your behalf, such as a caregiver, family member, or facility staff) agree to provide accurate and complete information when booking transportation services, including the passenger’s name, contact information, pickup/drop-off location, and any special requirements or accommodations. The Responsible Party is also responsible for selecting the most appropriate service type based on the passenger’s condition and needs.
 
3.2 Compliance with Laws: You agree to comply with all applicable laws, regulations, and guidelines governing the use of our services, including but not limited to traffic laws, safety regulations, and healthcare privacy laws such as HIPAA (Health Insurance Portability and Accountability Act).
 
3.3 Conduct: You agree to behave in a respectful and courteous manner towards our drivers, staff, and other passengers. Any behavior deemed disruptive, threatening, or unlawful may result in denial of service and termination of your account.
 
4. Liability and Disclaimers
 
4.1 Limitation of Liability: To the fullest extent permitted by law, the company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services, including but not limited to personal injury, property damage, or loss of income.
 
4.2 Disclaimer of Warranties: Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We make no representations or warranties regarding the accuracy, reliability, or suitability of the services for any particular purpose.

 

4.3 Scope of Service: Drivers will provide reasonable assistance with entering and exiting the vehicle, securing mobility devices, and transportation between designated pickup and drop-off locations. However, drivers are not trained medical staff and cannot provide lifting, medical transfers, or personal care. Passengers who require such assistance must be accompanied by a qualified caregiver. Drivers are not permitted to provide medical care, lifting, or transfers between beds, chairs, or wheelchairs.

While our staff will assist within safe limits, we are not responsible for injuries, accidents, or incidents that occur during these transfers or while under the care of caregivers, family members, or other third parties.

4.4 Injuries and Accidents: While reasonable non-medical assistance may be offered, Suncore Transport and its employees are not responsible for injuries, accidents, or incidents that occur inside a residence, hospital, or facility, on stairs, curbs, walkways outside the vehicle, or during transfers performed by individuals, caregivers, or other third parties. Passengers agree to indemnify and hold harmless Suncore Transport from claims, damages, or liabilities arising from their own actions or omissions.

 

4.5 Eligibility & Medical Fitness: Passengers must be medically stable to travel in a non-emergency transport vehicle. If a passenger requires continuous monitoring, advanced medical assistance, or is otherwise unsafe to transport, Suncore Transport reserves the right to decline service. The Responsible Party booking the ride is responsible for confirming that the passenger is medically stable to travel and does not require continuous monitoring or advanced medical assistance. Passengers and Responsible Parties must also ensure the service type booked is appropriate for the rider. If the incorrect service is booked, Suncore Transport reserves the right to refuse service or adjust pricing accordingly.

4.6 Medical Care: Drivers do not provide medical evaluation, monitoring, or emergency treatment. Our services are not a substitute for emergency medical transport. In the event of a medical emergency, 911 will be called. The company is not liable for medical events or health conditions that occur during transport unless caused by gross negligence.

4.7 Property Damage: The company is not responsible for damage to personal mobility devices such as wheelchairs, walkers, scooters, or oxygen tanks unless caused by gross negligence. Suncore Transport is also not responsible for loss or damage to passengers’ personal property, including phones, bags, and other belongings, unless caused by gross negligence. 

 

4.8 Service Delays: The company is not liable for delays, missed appointments, interruptions, or cancellations of service due to circumstances beyond its control, including but not limited to traffic conditions, weather, mechanical issues, severe weather events, natural disasters, public health emergencies, labor disputes, or acts of government.

 

4.9 Passenger and Caregiver Responsibilities: Passengers must be ready at the scheduled pickup time. The Responsible Party booking the ride is responsible for ensuring the passenger is prepared and, if needed, that a caregiver is present. If a passenger requires assistance beyond the driver’s role, such as stairs, transfers, or medical support, a caregiver must be present. The individual or organization booking the ride (the “Responsible Party”) is responsible for ensuring that any required caregiver is available, and for disclosing all relevant medical, mobility, or behavioral conditions at the time of booking. Passengers, caregivers, and Responsible Parties agree to conduct themselves respectfully. Service may be refused or terminated if unsafe or disruptive behavior occurs. Drivers may also decline transport if a passenger’s behavior, condition, or equipment poses a risk to safety, even if the ride was pre-booked and confirmed.

4.10 Mobility Devices: Passengers, Responsible Parties (including caregivers, family members, or facilities booking on the passenger’s behalf), and equipment providers are solely responsible for ensuring that any wheelchairs, walkers, scooters, oxygen tanks, or other mobility devices are safe, properly maintained, and in good working condition prior to transport.

Suncore Transport is not responsible for incidents, malfunctions, or injuries arising from defective, unsafe, or improperly maintained equipment.

4.11 Acknowledgment: By booking transportation with Suncore Transport, passengers, caregivers, and Responsible Parties acknowledge these terms, accept personal responsibility for activities outside the driver’s scope, and release Suncore Transport and its employees from liability beyond safe boarding, securement, and transport. Acknowledgment may be made through online booking, signed documents, or acceptance on recorded phone lines.

 

4.12 Indemnification: Passengers, caregivers, and Responsible Parties agree to indemnify and hold harmless Suncore Transport and its employees from any claims, damages, or expenses arising from their own negligence, misconduct, or failure to disclose relevant medical or mobility information.


5. Intellectual Property
 
5.1 Ownership: All content and materials available on the Site, including but not limited to text, graphics, logos, images, and software, are the property of Suncore Transport or its licensors and are protected by copyright, trademark, and other intellectual property laws.
 
5.2 Use Restrictions: You may not modify, reproduce, distribute, transmit, or create derivative works of any content or materials from the Site without our prior written consent.
 
6. Messaging Terms & Conditions
 
6.1 Types of Messages: By booking with Suncore Transport, you agree to receive various types of SMS messages, including but not limited to:
 

  • Appointment reminders

  • Order alerts

  • Account notifications

  • Promotional offers

  • Service updates

  • Customer support messages

 
 6.2 Opt-In Language: By sharing your phone number, you agree to receive text messages from us about current and future rides as well as upcoming promotions and updates.
 
6.3 Messaging Frequency: The frequency of SMS messages may vary based on your interactions with our services and the type of messages you receive. You may receive messages more frequently during peak times or when there are important updates.
 
6.4 Message and Data Rates: Standard message and data rates may apply to any SMS messages sent or received as part of our messaging services. These rates are determined by your mobile carrier and are not controlled by Suncore Transport.
 
6.5 Opt-Out Instructions: You can opt out of receiving SMS messages at any time by texting STOP to our messaging number. Upon receiving your opt-out request, we will send a confirmation message and you will no longer receive SMS messages from us. If you wish to re-subscribe, you can text START to the same number.
 
6.6 Assistance and Support: If you need assistance or have any questions regarding our SMS messaging services, you can text HELP to our messaging number. Additionally, you can visit our Privacy Policy further support and information.
